1. Acceptance of Terms

We reserve the right to decline any project at our discretion. Availability of services may vary by location, season, and project type.

3. Estimates and Pricing

All estimates provided by Pasadena Asphalt Paving Company are based on the information available at the time of assessment. Estimates are not final contracts. A written proposal or work order signed by both parties constitutes the binding agreement for pricing and scope of work.

Prices may change if the scope of work changes after an estimate is issued, if unforeseen site conditions are discovered during work, or if material costs change between the date of the estimate and the start of the project. Any change to the original scope or price will be discussed with you before additional work proceeds.

Estimates expire 30 days from the date issued unless otherwise noted in writing.

4. Scheduling and Cancellation

Project dates are scheduled based on mutual availability, crew capacity, and weather conditions. Asphalt paving and sealcoating work cannot be performed in rain or when ground or surface temperatures are not suitable. We reserve the right to reschedule any job due to weather conditions without penalty.

If you need to cancel or reschedule a confirmed project, please notify us as soon as possible. Cancellations made with less than 48 hours notice may be subject to a cancellation or preparation fee if materials were ordered or crews were mobilized for your job. Any applicable fees will be communicated to you at the time of booking.

We are not liable for delays caused by weather, material shortages, permit processing delays, or other circumstances outside our control.

5. Payment Terms

Payment terms will be set out in your written proposal or work order. In general:

• A deposit may be required before work begins on larger projects.
• Final payment is due upon completion of the project unless otherwise agreed in writing.
• Accepted payment methods will be specified in your proposal.
• Invoices not paid within 30 days of the due date may accrue late fees at the rate permitted by applicable California law.

If a project is paused or stopped at the customer's request before completion, payment is due for all work completed to that point plus any materials purchased for the project.

6. Customer Responsibilities

Before work begins, you agree to:

• Remove all vehicles, personal property, and obstructions from the work area.
• Provide accurate information about underground utilities, irrigation lines, or other subsurface features that could affect the work.
• Notify us of any HOA requirements, permit requirements, or site-specific conditions that may affect the project.
• Ensure that the work area is accessible to our crew and equipment on the scheduled date.

We are not responsible for damage to unmarked or undisclosed subsurface features such as irrigation lines, electrical conduit, or drainage pipes.

7. Warranty Disclaimer

We stand behind our work and aim to deliver quality results on every project. Any warranty for materials or workmanship will be specified in your written proposal.

Unless a written warranty is expressly provided, our services are provided "as is." We do not make any implied warranties of merchantability or fitness for a particular purpose beyond what is stated in writing.

Asphalt is a natural material that expands, contracts, and changes over time in response to temperature, load, and ground movement. Normal surface cracking, slight color variation, and minor imperfections that appear after installation are not covered as defects unless they are directly attributable to improper workmanship identified within the warranty period stated in your proposal.

Tree root damage, earthquake damage, or damage caused by extraordinary loads or improper use of the surface after installation is not covered by any workmanship warranty.

8. Limitation of Liability

To the fullest extent permitted by law, Pasadena Asphalt Paving Company is not liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the services we provide or our website, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from or related to a specific project shall not exceed the total amount paid by you to us for that project.

This limitation of liability applies to property damage, personal injury, loss of use, or any other claim, to the maximum extent permitted by California law.

9. Website Use

You may use our website for lawful purposes only. You agree not to use our website to transmit any content that is unlawful, harmful, defamatory, or otherwise objectionable, and not to interfere with the operation of the website or its infrastructure.
